What is a Notice of Seeking Possession?

This is the first stage of legal action which allows a landlord to apply for the possession of a tenant's home.  Usually a Notice of Seeking Possession is served when a tenant is more than 4 weeks in rent arrears and legal action is being considered to recover the debt.

If you have been served with a Notice you should contact an Income Recovery Officer immediately to discuss how you will clear the arrears and avoid further legal action being taken.  If after 28 days, of a Notice being served, the arrears have not cleared or an agreement is not being maintained to satisfactorily reduce the arrears you will then be at risk of losing your home as the next stage in legal action would be to apply to the Court for a Possession Order.  If Court action is taken any costs incurred are payable by the tenant.
